Terms of Use

Please read these Terms of Use carefully before accessing or using any part of the Melvadu platform available at melvadu.com. By accessing or using the platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform.
1. Definitions
Throughout these Terms, the following definitions apply:
- Platform refers to the website, services, and digital content made available at melvadu.com.
- Company refers to Melvadu, the operator of the Platform.
- User refers to any individual who accesses or uses the Platform, whether registered or not.
- Account refers to a registered user profile created on the Platform.
- Content refers to all text, video, audio, images, course materials, and any other information available on the Platform.
- Subscription refers to a paid or free plan granting access to specific features or Content.
2. Acceptance of Terms
By creating an Account, purchasing a Subscription, or otherwise using the Platform in any capacity, you enter into a binding agreement with the Company under these Terms. These Terms apply to all Users regardless of how they access the Platform.
If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
3. Eligibility
You must be at least 16 years of age to use the Platform independently. Users under the age of 16 may only access the Platform with verifiable parental or guardian consent. By using the Platform, you represent that you meet these eligibility requirements.
The Company reserves the right to refuse access to any User who does not meet eligibility requirements or who has previously had their Account suspended or terminated.
4. Account Registration
4.1 Creating an Account
Certain features of the Platform require you to register for an Account. When registering, you agree to provide accurate, current, and complete information. You are responsible for keeping your Account information up to date.
4.2 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must notify the Company immediately at support@melvadu.com if you suspect unauthorized access to or use of your Account.
4.3 One Account Per User
Each User may maintain only one Account. Creating multiple Accounts to circumvent restrictions, access multiple trial periods, or abuse promotions is prohibited and may result in termination of all associated Accounts.
5. Use of the Platform
5.1 Permitted Use
The Platform is made available for your personal, non-commercial educational use. You may access and engage with the Content provided to you through your Subscription or free access tier for the purpose of learning and personal development.
5.2 Prohibited Conduct
You agree not to engage in any of the following:
- Reproducing, distributing, selling, or publicly displaying any Content without written authorization from the Company.
- Using automated tools, bots, scrapers, or similar mechanisms to access or extract Content.
- Attempting to gain unauthorized access to the Platform, its infrastructure, or other Users' Accounts.
- Uploading or transmitting malicious code, viruses, or harmful data.
- Impersonating another person or misrepresenting your affiliation with any entity.
- Using the Platform for any unlawful purpose or in violation of applicable regulations.
- Interfering with the operation or security of the Platform or its related systems.
- Sharing Account credentials with third parties or enabling unauthorized access by others.
5.3 Academic Integrity
Users are expected to engage with educational materials honestly and in good faith. Misrepresenting completion of courses, assessments, or certifications is strictly prohibited.
6. Subscriptions and Payments
6.1 Subscription Plans
The Company offers various Subscription plans that may differ in the level of Content access, features, and duration. Details of available plans are presented on the Platform at the time of purchase.
6.2 Billing
All fees are stated in the applicable currency at checkout and are inclusive of any applicable taxes where required. Payment is due at the time of purchase or at the start of each billing cycle for recurring Subscriptions. You authorize the Company to charge your selected payment method accordingly.
6.3 Renewals
Recurring Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You will receive a reminder prior to renewal where required. Continued use of the Platform after a renewal date constitutes acceptance of the renewed Subscription.
6.4 Cancellations
You may cancel your Subscription at any time through your Account settings or by contacting support@melvadu.com. Cancellation takes effect at the end of the current billing period. Access to Subscription features continues until that date.
6.5 Refunds
Refund eligibility is determined in accordance with the Company's refund policy, available on the Platform. Refunds are not issued for partial periods of use unless required by applicable law.
6.6 Pricing Changes
The Company reserves the right to change Subscription pricing at any time. Existing subscribers will receive advance notice of pricing changes before they take effect.
7. Intellectual Property
7.1 Company Ownership
All Content on the Platform, including but not limited to course materials, videos, written text, graphics, logos, and software, is the property of the Company or its licensors and is protected by applicable intellectual property laws. No rights are transferred to you beyond what is expressly stated in these Terms.
7.2 Limited License
Subject to your compliance with these Terms and your active Subscription where applicable, the Company grants you a limited, non-exclusive, non-transferable, revocable license to access and view Content solely for your personal educational use on the Platform.
7.3 Restrictions
You may not copy, download, record, modify, translate, create derivative works from, publicly perform, or otherwise exploit any Content beyond the personal use described above, without prior written consent from the Company.
7.4 Feedback
If you submit any suggestions, feedback, or ideas to the Company, you grant the Company a perpetual, royalty-free, worldwide license to use, incorporate, and act upon such feedback without obligation or compensation to you.
8. User-Submitted Content
Where the Platform permits Users to submit content such as comments, questions, or reviews, you retain ownership of what you submit. By submitting content, you grant the Company a non-exclusive, royalty-free license to display and use that content in connection with the operation of the Platform.
You represent that any content you submit does not infringe third-party rights, violate applicable law, or contain harmful, defamatory, or misleading material. The Company reserves the right to remove any User-submitted content at its discretion.
9. Privacy
Your use of the Platform is also governed by the Company's Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you acknowledge that you have reviewed the Privacy Policy and consent to the data practices described therein. For questions about personal data, contact support@melvadu.com.
10. Third-Party Services and Links
The Platform may contain links to third-party websites or integrate with third-party services. These are provided for convenience only. The Company does not endorse, control, or take responsibility for the content, privacy practices, or availability of any third-party resources. Your interactions with third-party services are governed by their own terms and policies.
11. Disclaimers
The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. The Company does not warrant that:
- The Platform will be uninterrupted, error-free, or free from harmful components.
- The Content is accurate, complete, or up to date at all times.
- The Platform will meet your specific educational or professional requirements.
Educational content on the Platform is intended for informational and learning purposes. It does not constitute professional advice of any kind.
12. Limitation of Liability
To the fullest extent permitted by applicable law, the Company, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Platform, including but not limited to loss of data, revenue, or business opportunity.
The Company's total aggregate liability for any claim arising out of these Terms or your use of the Platform shall not exceed the total amount paid by you to the Company in the twelve months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, employees, and licensors from and against any claims, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
14. Suspension and Termination
14.1 By the Company
The Company reserves the right to suspend or terminate your Account and access to the Platform at any time if you violate these Terms or engage in conduct deemed harmful to other Users, the Platform, or the Company. Notice will be provided where reasonably practicable.
14.2 By You
You may close your Account at any time by contacting support@melvadu.com. Upon closure, your access to Content and Account features will cease at the end of any active billing period.
14.3 Effect of Termination
Upon termination for any reason, provisions of these Terms that by their nature should survive will continue to apply, including intellectual property rights, limitations of liability, and indemnification obligations.
15. Modifications to the Platform
The Company reserves the right to modify, update, suspend, or discontinue any part of the Platform at any time without prior notice. The Company will not be liable to you or any third party for any modification, suspension, or discontinuation of services.
16. Changes to These Terms
The Company may update these Terms from time to time. The updated version will be posted on the Platform with a revised "Last updated" date. Continued use of the Platform after the posting of updated Terms constitutes your acceptance of those changes. If changes are material, the Company will make reasonable efforts to notify you in advance.
17. Governing Principles
These Terms are intended to be interpreted in a manner consistent with applicable law in the jurisdiction where the Company operates. Where any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
